DUNDAS BROKERS WEBSITE TERMS OF USE
These Website Terms of Use (the “Terms”) govern your access to and use of www.dundasbrokers.com and its related pages and forms (the “Website”). The Website is operated by Dundas Life Inc. (“Dundas”, “we”, “us”), an Ontario corporation and licensed insurance agency (FSRA licence #37628M) located at 215 Spadina Ave, Suite 400, Toronto, Ontario M5T 2C7, Canada. Dundas Brokers is a division of Dundas Life Inc., which also carries on business as Dundas Life and Dundas Wealth.
Participation in a Dundas Brokers program is governed solely by your signed Insurance Lead Generation Services Agreement and its schedules. These Terms do not set, describe, change or add to any program’s fees, deposits, commission shares, appointment commitments or other program terms. If anything on the Website differs from your signed agreement, your signed agreement governs.
BY ACCESSING OR USING THE WEBSITE, OR BY PROVIDING YOUR INFORMATION THROUGH OUR FORMS OR THIRD-PARTY PLATFORMS (INCLUDING BUT NOT LIMITED TO FACEBOOK LEAD FORMS), YOU AGREE TO BE BOUND BY THESE TERMS AND THE DUNDAS PRIVACY POLICY.
YOU ACKNOWLEDGE THAT INFORMATION SUBMITTED THROUGH THIRD-PARTY PLATFORMS MAY ALSO BE SUBJECT TO THOSE PLATFORMS’ OWN TERMS AND DATA POLICIES (INCLUDING, FOR EXAMPLE, FACEBOOK’S DATA POLICY), AND MAY BE USED IN ACCORDANCE WITH THOSE POLICIES.
IF YOU DO NOT AGREE WITH THESE TERMS OR THE DUNDAS PRIVACY POLICY, DO NOT ACCESS OR USE THE WEBSITE OR PROVIDE YOUR INFORMATION.
Content on the Website, including descriptions of programs, calculators, examples and case figures, is general information for licensed insurance advisors. Figures are illustrative and are not a promise of any particular result, income or business outcome. Nothing on the Website is insurance, tax, legal or financial advice. Any commitment Dundas makes to an advisor is made only in a signed written agreement.
Dundas Brokers programs are offered to licensed advisors in the provinces stated on the Website and in the applicable agreement. DUNDAS DOES NOT CONDUCT BUSINESS IN QUEBEC. The Website is void where prohibited by law.
We may modify the Website and these Terms at any time. Where we make material changes to these Terms, we will update the “Last updated” date above. Your continued use of the Website after changes are posted means you accept the updated Terms. We may restrict or remove access to any part of the Website at any time.
You must be 18 years of age or older to use the Website. We grant you a revocable, non-exclusive, non-transferable, limited licence to access and use the Website in accordance with these Terms. You agree not to make any false or fraudulent statements when using the Website or submitting a form. Except as expressly permitted, you agree not to sell, license, rent, modify, distribute, copy, reproduce, republish or create derivative works from materials on the Website.

If you have an account for Dundas tools reached through the Website (for example, the broker portal or CRM), you are responsible for keeping your login credentials confidential, for all activity under your account, and for notifying us promptly at support@dundas.life of any unauthorized access. Customer information and leads made available to you may be used only to respond to those customers about insurance products and services, and only in compliance with your signed agreement and all applicable privacy and anti-spam laws (including PIPEDA, applicable provincial privacy legislation and Canada’s Anti-Spam Legislation). You are responsible for your own licensing, errors and omissions insurance, regulatory obligations and the content of any communications or marketing you send. We may suspend access to the Website or tools where we reasonably believe these Terms or applicable law have been breached.
We use reasonable efforts to keep the Website accurate and current, but we do not warrant that it will be error-free. Data entry errors or technical problems may sometimes result in inaccurate information being shown, and we may correct any inaccuracy at any time. We are not responsible for content posted or uploaded by users or third parties.
The design, text, graphics, calculators, selection and arrangement of content on the Website are owned by or licensed to Dundas and are protected by copyright and other laws. ALL RIGHTS RESERVED. Dundas’s names, logos, and product and program names are trademarks or trade dress of Dundas Life Inc. Use of any of these without our prior written permission is prohibited.
The Website may link to or embed third-party services (for example, scheduling, video, form and analytics providers). We do not control and are not responsible for third-party websites or services, and your use of them is subject to their own terms. Parts of the Website rely on third-party providers, so the Website may at times be interrupted or unavailable for reasons outside our control. The Website and related services are hosted in Canada and the United States.
THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES, CONDITIONS OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUNDAS EXPRESSLY DISCLAIMS ALL WARRANTIES WHICH MIGHT APPLY TO THE WEBSITE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THIS SECTION LIMITS ANY COMMITMENT DUNDAS MAKES IN A SIGNED WRITTEN AGREEMENT.
TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT WILL DUNDAS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) ARISING OUT OF THESE TERMS OR THE USE OF, OR INABILITY TO USE, THE WEBSITE, INCLUDING ANY INFORMATION MADE AVAILABLE THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DUNDAS’S MAXIMUM LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). THIS SECTION DOES NOT APPLY TO OBLIGATIONS UNDER A SIGNED WRITTEN AGREEMENT, WHICH ARE GOVERNED BY THAT AGREEMENT.
Without limiting the above, Dundas is not liable for: late, lost or misdirected electronic correspondence; any interruption, error, defect, delay, virus or system failure affecting the Website; unauthorized access to our servers or the information stored on them; or statements or conduct of any third party.
You agree to defend, indemnify and hold harmless Dundas and its affiliates, and their officers, directors, employees, agents and contractors, from all liabilities, claims and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Website.
When you submit a form on the Website, the form tells you what messages you may receive from us. You can withdraw your consent to receive commercial electronic messages at any time using the unsubscribe link in any message or by emailing support@dundas.life.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You and Dundas attorn to the exclusive jurisdiction of the courts of Ontario for any dispute arising from these Terms or the Website.
Except where prohibited by applicable law, you waive any right to commence or participate in a class action against Dundas relating to the Website.
If any provision of these Terms is found invalid or unenforceable, it will be severed and the remaining provisions will continue in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
You may not assign these Terms. Dundas may assign these Terms to an affiliate or successor.
These Terms and the Dundas Privacy Policy are the entire agreement between you and Dundas about your use of the Website. Your participation in any Dundas Brokers program is governed by your signed Insurance Lead Generation Services Agreement and its schedules.
